Jerald Finney was the lead counsel for the Biblical Law Center ("BLC") from May, 2005 until 2011. The BLC helps churches who desire to organize according to New Testament principles. In 2016, he again worked with the BLC and still does, but he now heads up the Churches under Christ Ministry which is under the authority of Charity Baptist Tabernacle of Amarillo TX. Finney is a licensed attorney who can be reached at 512-785-8445 jerald.finney@sbcglobal.net. Over the last few years he has lectured and preached on the issues concerning government, church, and separation of church and state. God called Finney, a Christian and fundamental Baptist since his salvation, to enter the University of Texas School of Law in 1990 at the age of 43 to stand in the gap concerning legal issues facing Christians. Since being saved, he has been a faithful and active member of a local fundamental, Bible-believing Baptist church. He received his JD degree in 1993 and has followed the Lord in the practice of law since that time. Finney received his law license in November 1993 and began practicing law in January, 1994. All along he was seeking the Lord’s direction. The Lord initially led Finney to practice criminal law. He knew that not many, if any, of the Christian law firms dealt with or specialized in criminal law, and that some Christians were being charged with crimes for their Christian behavior and for taking a stand for God’s principles. The Lord confirmed Finney's choice. Very soon after he started practicing, he helped an Eastern Orthodox priest with a criminal charge. He was charged under a criminal statute for trying to expose the promotion of sodomy and other sins within a Catholic Church. God gave the victory in that case. Then Steve, a Christian who counseled outside abortion clinics, called Finney. He was charged with a crime under the Austin, Texas Sign Ordinance for his activities outside an abortion clinic. Being a new lawyer, Finney called the Rutherford Institute. They asked him to send them a summary of the facts and a copy of the Sign Ordinance. Then they told him that the case could not be won and that they would not help. Steve lost at trial, but God gave the victory on appeal. The Austin Police Department immediately cited Steve for violation of the state sign ordinance. The Lord gave the victory at trial. Finney's first felony trial came about a year and six months after he started practicing law. A single Christian mother was charged with third degree felony injury to a child for spanking her six year old son. She left some prominent stripes across his rear end and also a stripe across his face when he turned suddenly during the spanking. The Lord gave the victory at trial. At the same time, Finney was also representing another Christian married lady who was charged with the same crime for spanking her little girl with a switch. On the date the trial in that case was to begin, the prosecutor, with prompting by the judge, lowered the offer to deferred adjudication probation of short duration on a misdemeanor charge with very few conditions on the probation. In a deferred adjudication in Texas, there is never a judgment of guilt if the probationer successfully completes the term of the probation, (and, with successful completion of the probation, the probationer can now file a Motion for Nondisclosure which, if granted, requires the file to be sealed so that the general public has no access to it). The mother decided to take the offer. The Lord has also allowed Finney to help Christian parents in numerous situations involving Child Protective Services (“CPS”) infringement into parental rights. God has given the victory in all those situations. The Lord has also used Finney to intervene in numerous situations where government officials or private companies tried to deny certain Christians their rights to do door-to-door evangelization, preach on the street, hand out gospel literature in the public forum, and pass out gospel tracts and communicate the gospel at their place of employment. Finney has also fought other legal spiritual battles including a criminal case in San Antonio. A peaceful pro-life advocate was arrested and charged with criminal trespass for handing pro-life literature giving information about the development of the unborn baby, places to go for help, and other information to women entering an abortion clinic. All the above-mentioned cases as well as others not mentioned were handled free of charge (except the last spanking case for which Finney received $750). In 2005 Finney became lead counsel for the Biblical Law Center. Since his early Christian life, he has considered the issue of separation of church and state as taught in the Bible to be one of the primary issues facing New Testament churches today. He believes, based upon what the Bible teaches, that operating as a corporation (sole or aggregate), unincorporated association, or any other type of legal entity and/or getting a tax exempt status from the federal government at the very least puts the church under the headship of both the Lord and the state, and may even take the church from under the headship of Christ and put the church under the headship of the state. He believes that taking scriptures out of context and applying human reasoning contrary to biblical teaching (such as “Obey every ordinance of man,” or “We should be good stewards and incorporation is good stewardship”) in order to justify unbiblical marriage with the state causes our Lord much grief. Once he took on the position as counsel for the BLC, it was necessary to do an in-depth study of the issue of separation of church and state. He began with the Bible. He initially read through the Bible at least five times (and many more times since then) primarily seeking the answer to the question, “Does the Bible have anything to say about this issue?” He was amazed at what He learned. The Bible gives God’s principles concerning separation of church and state, the purpose of a church, the purpose of the civil government, the headship of church, the headship of civil government, the principles by which each is to be guided, and much more concerning these two God ordained institutions. He continued to read the Bible daily seeking insights into these and other issues. He also began to read other books. he had already read starting shortly after being saved, books and other information by Christian authors. For example, he had read, among other works, A Christian Manifesto[1], The Light and the Glory,[2] From Sea to Shining Sea,[3] The Myth of Separation and some other works by David Barton, [4]Rewriting America’s History,[5] and America’s God and Country.[6] These resources inspired, influenced and guided him and millions of other Christians, gave them philosophical and historical underpinning, and led them into battlefields such as politics, law, and education armed with what they learned from those resources. Sometime in 2006 he began to realize that some of the books by Christian authors which he had come to depend upon were misleading, at the very least. Other books revealed to him that some of the above mentioned books had misinformed and misled sincere Christians by revising and/or misrepresenting the true history of separation of church and state in America. In 2006, he read One Nation Under Law[7] which cites a wealth of resources for one seeking to understand the history of separation of church and state in the United States and of the First Amendment to the United States Constitution.[8] Reading One Nation Under Law, some of the books it cited, and some other books was a launching pad into the universe of historical information which he never dreamed existed. He had expected to be misled in the secular law school he attended. He was amazed that he had been misled by Christian brothers. I asked myself, “How could Peter Marshall and others have missed this vital information?” At an Unregistered Baptist Fellowship conference in Indianapolis, Indiana, James R. Beller, a Baptist historian, gave a PowerPoint presentation which gave him the answer to this question. Finney bought two of Beller's books and read them. Those books filled in the details not mentioned in Pastor Beller’s concise PowerPoint presentation. Since that time, God has led Finney into an in depth study of the issues of government, church, and separation of church and state. God Betrayed/Separation of Church and State: The Biblical Principles and the American Application and the other books he has written and listed on this website were written as a result of those studies. God Betrayed is not a rehash of the same information that has been circulated in the Fundamental Baptist and Christian community through sermons, books, seminars, etc. since at least 1982, the year Finney was saved. God Betrayed and Finney's other books reveal facts and information that must be understood in order for a pastor and other Christians to begin to successfully (in God's eyes) fight the spiritual warfare we are engaged in according to knowledge. Finney believes that the lack of attention to the biblical doctrines concerning government, church (which is likened to the wife and bride of Christ), and separation of church and state, has had dire consequences for individuals, families, churches, and America. In John Adams: Was He Really an Enemy of Christians? Addressing Modern Academic Shallowness David Barton wrote, “non-Biblical Christianity and non-Biblical Christians still drive people away from the Christian faith rather than to it,” a true statement. However, sad to say, David Barton’s form of Christianity is non-Biblical and is driving people from the Christian faith. Please read further before summarily discounting this truth which is offered by a believer who once admired David Barton and worked with millions of other “Christians” in the Republican Party to bring America back under God. After 20 years of work as a voter, precinct chairman, election judge,  member of various Republican Party committees, and delegate to Republican conventions, etc. starting in the early 1980’s after being saved, I saw that all our efforts in the political system were anti-productive. Then, I became lead counsel for the Biblical Law Center helping churches to remain free from government control. As a believer first and a lawyer second, I began intense, in-depth studies of the relevant Biblical/legal/historical principles which continue to this day. To my dismay, I began to realize that for 20+ years I had worked for a misguided cause led by men such as David Barton who are “Christian Revisionists.”

“The night is far spent, the day is at hand: let us therefore cast off the works of darkness, and let us put on the armour of light” (Romans 13:12). This author could spend every minute of every day refuting the false teachings of David Barton and other Christian revisionists, but he does not have the time to do that. Every believer has God-given responsibilities, but most may not have the time to do the study needed to discern truth about, for example, some Biblical principles, history, and law. One who has grown weary of witnessing the futility of his efforts in politics and elsewhere may go to the resources mentioned below for light which will expose the works of darkness. When a believer proceeds with knowledge, understanding, and wisdom, he will not be fooled by the works of darkness.

On August 23, 2009, I began a radio broadcast series on the “History of the First Amendment.”  This series is loaded with facts that every Christian who desires to make a difference in turning America back to God must know. The facts presented are irrefutable, but most Christians don’t know them. I do not give all my sources on the broadcasts, but the sources are fully cited in God Betrayed: Separation of Church and State: The Biblical Principles and the American Application. For many years I followed Christian revisionism. I was ignorant, but not willfully ignorant. If you have obtained your information from men such as the men I had followed and applauded for many years (the most influential of which was David Barton), you have been misled. Hosea 4:6-11  “My people are destroyed for lack of knowledge: because thou hast rejected knowledge, I will also reject thee, that thou shalt be no priest to me: seeing thou hast forgotten the law of thy God, I will also forget thy children.  As they were increased, so they sinned against me: therefore will I change their glory into shame. They eat up the sin of my people, and they set their heart on their iniquity.  And there shall be, like people, like priest: and I will punish them for their ways, and reward them their doings.  For they shall eat, and not have enough: they shall commit whoredom, and shall not increase: because they have left off to take heed to the LORD. Years ago, I read The Myth of Separation by David Barton. I was enlightened in many ways because I had not done my own research on the subject he was addressing. However, even in the first reading, I noticed how sloppy his writing was. Later, I began to realize that he made many factual errors and that many times his citations did not go back to reliable sources. In spite of this, I was a faithful follower of and advocate for David Barton for many years because I did not have the time to do an independent study.

Secularists, who are the worst of revisionists, find Barton (and his followers) easy prey for criticism because Barton’s works (books, DVD’s, etc.) have many  inaccurate statements. Barton also relies heavily on half truths, often failing to tell the whole story behind selected historical incidents. Furthermore, he advocates a false biblical interpretation concerning the relationship of church and state. He believes in union of church and state. The correct biblical principle for Gentile nations is separation of church and state, but not separation of God and state, a concept which is alien to Barton. I fully explain these biblical concepts in God Betrayed. Because he is so charismatic, he has gained probably millions of Christian followers. He and others of like mind have done irreparable harm to the cause of Christ in America. The blind are leading the blind.

Actually, the tactic of Christian revisionists do not change. Isaac Backus wrote in the late 1700’s of the tactics of the Calvinists (Puritans) that which is historically verified by comparing Puritan writings and subsequent Calvinist historical offerings with true facts:

  • “[I] appeal to the conscience of every reader, whether he can find three worse things on earth, in the management of controversy, than, first, to secretly take the point disputed for truth without any proof; then, secondly, blending that error with known truths, to make artful addresses to the affections and passions of the audience, to prejudice their minds, before they hear a word that the respondent has to say; and thirdly, if the respondent refuses to yield to such management, then to call in the secular arm to complete the argument?” Isaac Backus, A History of New England With Particular Reference to the Denomination of Christians called Baptists, Volume 1 (Eugene, Oregon: Wipf & Stock Publishers, Previously published by Backus Historical Society, 1871), p. 150.

Let me give you just one example of his fallacies (here pointed out by a secularist, but which has also been pointed out along with other mistakes and fallacies in Barton’s works in Christian literature I have read):

“On page 120 of David Barton’s book The Myth of Separation, David Barton quotes James Madison as saying:

‘We have staked the whole future of American civilization not upon the power of government, far from it. We have staked the future of all our political institutions upon the capacity of mankind for self-government, upon the capacity of each and all of us to govern ourselves, to control ourselves, to sustain ourselves according to the Ten Commandments.’

“Barton gives the following footnote for the quotation:

” Harold K. Lane, Liberty! Cry Liberty! (Boston: Lamb and Lamb Tractarian Society, 1939), pp. 32-33. See also Fedrick Nyneyer, First Principles in Morality and Economics: Neighborly Love and Ricardo’s Law of Association (South Holland” Libertarian Press, 1958), pp. 31.

“The only problem with the above is, no such quote has ever been found among any of James Madison’s writings. None of the biographers of Madison, past or present have ever run across such a quote, and most if not all would love to know where this false quote originated. Apparently, David Barton did not check the work of the secondary sources he quotes….”

God is very clear about what happens when one makes lies his refuge:

 Isaiah 28:14-18:  “Wherefore hear the word of the LORD, ye scornful men, that rule this people which is in Jerusalem. Because ye have said, We have made a covenant with death, and with hell are we at agreement; when the overflowing scourge shall pass through, it shall not come unto us: for we have made lies our refuge, and under falsehood have we hid ourselves: Therefore thus saith the Lord GOD, Behold, I lay in Zion for a foundation a stone, a tried stone, a precious corner stone, a sure foundation: he that believeth shall not make haste. Judgment also will I lay to the line, and righteousness to the plummet: and the hail shall sweep away the refuge of lies, and the waters shall overflow the hiding place. And your covenant with death shall be disannulled, and your agreement with hell shall not stand; when the overflowing scourge shall pass through, then ye shall be trodden down by it.”

EN1. A Christian friend wrote me over the internet:

“What I can’t figure out is why David Barton embraces Glenn Beck.  He knows better.”

My answer to her was:

Good to hear from you, _______________. David Barton knows exactly what he is doing. He is among those “Christians” who believe it is OK to lie for a higher cause. The problem is that his cause is not the cause of the remnant of Bible believing Christians.
At one time, David Barton was a hero of mine. However, when I began to intensely study the Bible (the Bible doctrines of church, state, and separation of church and state), history (the history of the First Amendment), and law (as to the First Amendment, church organization, the relationship between church and state), I found that David Barton was a false teacher (biblically, and especially historically). I had followed his, and other “Christian” writings (starting with The Light and the Glory  in the 1980s). I just believed these writings, the teachings of which are regularly repackaged, published, and sold to unknowledgeable “Christians” who go into the political realm and fight a political battle not according to knowledge.
I always knew that Barton’s writings were sloppy; but the real problems with his teachings and writings are much deeper. David Barton (and other leading “Christian” authors) select historical facts that support their goals, but leave out facts which give the whole truth. They, distort, lie, etc. This was a hard pill for me to swallow, but the truth is there when one studies it out. Once I learned that I had been used, lied to, and misled in order to support religious beliefs that were contrary to Scripture I became angry for a time.

The following is what little I have gleaned from my limited time looking at the matter. He is Pentecostal. He believes the church should control the state – that the state should prop up the church. He is a dominionist. He is part of the establishment; this is no problem for him because he believes the church and state are destined to work together to bring peace and unity. Of course, deceived “Christians” follow him because they have no understanding of history and Bible principles since, if they study at all, they follow the teachings of Christian revisionists such as David Barton. Cruz has David Barton at his side. Barton has done tremendous damage to the cause of Christ, since he is an outright liar and a dominionist. He revises history and lies. Lying is part of the arsenal of dominionists;  according to them, it is right to lie to those (like Christians who do not agree with their theology) who do not have the right to know the truth, especially if lying promotes their vision (which they, as heretics believe to be of God based upon their perverted interpretations of Scripture) for the world. That is why most “Christians” follow a perverted view of history which is more despicable than secular revisionist history. Most “Christians” just proceed ignorantly and follow their heretical and apostate leaders down the road to destruction – to a nation where church controls state and to a one world government where their hope is that church will control the world. So when articles state that Cruz is “deeply Christian” they just fall in line to support him. He is deeply heretical and tied directly to the establishment. Etc. Some things to google:

My people are destroyed for lack of knowledge

The more I learn about the subject of separation of church and state, the more I grieve. I grieve not because of the new knowledge gained, but because I am a Christian and find that for most of my Christian life I have been mislead by other Christians in whom I placed my trust. I grieve because other Christians whom I admire and respect refuse to get out of the box they are in, a box I was in for many years. That box is the box of Christian revisionism. Yes, Christian-not secular-revisionism.

Because of the false teaching that I was subjected to, I, along with millions of other Christians, engaged in the war to restore America as a nation under God not according to knowledge.  However, God offered new light to which I had never been exposed. I did not reject it, but absorbed it into my being. I learned truths about many matters–historical, theological (biblical), and legal–which were never revealed to me by those whom I had trusted. I learned cold hard facts that must be known for one to successfully “occupy” until Jesus comes.

I asked my spiritual peers and leaders to review my findings and to be honest with me in assessing those findings. No one refuted me, but my peers either loved or rejected me and my findings. Those who rejected just turned a cold shoulder, but never explained where I was wrong. Why? Willful ignorance? Phariseeism?

Unless Christians in America, in general, open their eyes and proceed according to knowledge, America is destined to the fate of Europe where only a minute fraction of the population is saved.  Unless “Bible believing churches” wake up and honor their head and husband, the Lord Jesus Christ, in all matters, those churches are doomed.
