Would man obey God on the basis of conscience, the restraint of the Holy Spirit, and human government? Man almost immediately failed to govern under God—Noah became drunk and incapable of ruling. Furthermore, Noah’s descendants rebelled against God’s command to populate the whole earth. The pattern has continued with every nation that has ever or will ever exist until Christ returns.
Shortly after the flood, God divided the world into nations: “By these were the isles of the Gentiles divided in their lands; every one after his tongue, after their families, in their nations.”[i] God probably did this because if all worldly government were concentrated in one world government, the potential for evil would be unlimited. As attorney John Eidsmoe wrote:
“Rulers are sinful and given too much authority can become oppressive tyrants. Nations check each other’s power. A one-world government would have no check on its power. No one could check violations on legal limitations and guarantees. World government has the potential for world tyranny.”[ii]
“The people, instead of obeying God’s command to scatter and fill the earth, conceived the idea of staying together and building the tower of Babel to achieve their aim. Fellowship with man replaced fellowship with God.”[iii] Soon after this division into nations, mankind attempted to build the world’s first “United Nations” building. “And they said, Go to, let us build us a city and a tower, whose top may reach unto heaven; and let us make us a name, lest we be scattered abroad upon the face of the whole earth.”[iv]
What was wrong with their attempt? “It was a picture of salvation by works, reaching heaven by one’s own efforts; one of its probable purposes was astrology or Satan worship, as with the ziggurat towers in ancient Babylonia; it was based on pride and self-exaltation. In addition, its purpose was to keep the people together in a one-world government instead of spreading them out into national entities as God had intended. The Jewish historian Flavius Josephus, writing shortly after the time of Christ, says: ‘Now it was Nimrod who excited them to such an affront and contempt of God…. He also gradually changed the government into tyranny—seeing no other way of turning them from the fear of God, but to bring them into a constant dependence upon his power. He also said … that he would build the tower too high for the waters to be able to reach and that he would avenge himself on God for destroying their forefathers….’
“As we can read in Genesis 11.5-9, God frustrated the building of the tower by causing the people to speak different languages. God then reaffirmed nationalism: ‘And from thence did the Lord scatter them abroad upon the face of all the earth’ (Genesis 11.9). God further reaffirms nationalism in Deuteronomy 32.9 and Acts 17.26. National entities will continue even during Christ’s millennial rule on earth (Isaiah 2.4; 66.18; Revelation 12.5; 20.3, 8), and perhaps even in heaven (Revelation 21.24, 26).”[v]
Thus, God again judged man for his failure to keep His command to populate the whole earth. God confused their language. Since they could no longer speak the same language, the builders could no longer understand one another. They separated and relocated to different parts of the earth. They began to populate the entire earth. God was giving man another chance for to govern under God according to His precepts for His purposes.
As we have seen, the Bible teaches that God can prevent man from setting up civil government, and He can ordain civil government. He is the Highest Power. At the same time, because God has given man free will, God does not force civil government to operate within the sphere of its God-given authority. All other powers, including all other governments and civil government officials and leaders are under Him, subject to His rules. In Romans we read, “Let every soul be subject unto the higher powers. For there is no power but of God: the powers that be are ordained of God.”[vi] Every soul includes leaders. Then in Romans 13.3-4, God lays out the jurisdiction of civil government consistently with principles for civil government in the Old Testament. Finally, God makes clear that man’s duties under God to civil government are parallel with the jurisdiction of civil government. As always, God declares that God’s children are to obey God rather than man when man’s laws contradict God’s laws.[vii]
God has judged all nations (civil governments) which have ever existed and will judge all nations whom He has not before judged.[viii]
All that God showed man as recorded in the Old Testament failed to convince mankind, excluding a remnant, that God was who He claimed to be, that His rules and principles could not be changed, that judgment falls upon individuals and institutions which do not operate according to His principles. As Isaac Backus observed: “Yet all this [all that God had done in the Garden of Eden, the flood, the ordaining of civil government] did not remove the dreadful distemper from man’s nature, for the great Ruler of the universe directly after the flood gave this as one reason why he would not bring such another while the earth remains, namely, For the imagination of man’s heart is evil from his youth.”[ix] “So that if he was to drown them as often as they deserved it, one deluge must follow another continually.”[x]

Knowing the correct answer to the question, “Is ‘Separation of Church and State found in the Constitution?” Knowing the correct answer to that question is vital in the success of the spiritual warfare of the Christian political activist in America. Does the First Amendment to the United States Constitution establish a wall which is to keep church out of state and state out of church; or does it set up a one way wall: that is, does it forbid state to stay out of church matters, but allow church to enter into state matters? If the latter, since “churches” vary in belief so dramatically, which church is to control in the affairs of state? Most Christians assert that the phrase “One nation under God” on our currency and in our Pledge of Allegiance make clear that the Constitution forbids separation of church and state. They state that the phrase “separation of church and state” is not found in the Constitution; that the Constitution through the First Amendment does not separate church and state. Are they correct in their understanding? I begin with an actual encounter with a “Christian” political activist over this matter of the meaning of separation of church and state. Then I:
1) briefly explain my position with reference particularly to the beliefs of Thomas Jefferson and James Madison (with links to more extensive and in depth studies);
2) briefly reveal those who are promoting the incorrect version of “separation of church and state” to conservative Americans (and more specifically to “Christians”) today and their motives;
3) briefly answer the question of whether the Constitution or any other governing document requires the federal government to be guided by God and His principles and explain how a nation can proceed under God without combining church and state;
4) briefly address biblical teaching on the downfall of a nation;
5) conclude.
In 2008, I started a seminar in El Paso, Texas with the diagram at left. A activist Christian lady immediately raised her hand and pointed out that the diagram separated church and state and that she did not agree with this. I had anticipated this question because I had struggled with the issue of separation of church and state for many years. Some years before this seminar I had begun to read in books and articles and to hear on Christian radio and from other Christians that “separation of church and state is not found in the Constitution.” I repeated that sound bite many times myself, but I was always perplexed as to where to go from the simple statement. I had read that the Supreme Court totally misinterpreted Jefferson’s Danbury Letter to mean that the First Amendment created a wall between church and state that was never intended. I had also read that the original intent of the religion clause of the First Amendment was to keep the state out of church affairs but not to keep the church out of state affairs; that the wall only functioned one way. Was this true? I found the answers to these questions after years of historical and legal studies.
This sign gets it wrong: we want Separation of Church and State not Separation of God and State
I answered the lady’s concerns by stating that I believed that she and I were on the same page; that I believe that most of our founding fathers never intended to separate God and state, but that they did indeed intend to separate church and state. I mentioned that the writings of James Madison, Thomas Jefferson, and most of our Founding Fathers showed that they understood this. They knew that church-state unions have always, without exception, resulted in the corruption of both church and state as well as individual citizens, horrible persecutions (imprisonments, murder and torture) of those who did not bow down to the established “church” and its theology, and many other undesirable consequences. The history of the First Amendment proves this (See the “History of the First Amendment” which is available online in the PDF of God Betrayed Section IVand in Online form). Madison and Jefferson were eyewitnesses to the persecutions of dissenting Baptists in Virginia and they understood the history of the persecutions of all those who exercised their God-given freedom to choose a theology contrary to that of the church-state unions, the establishment. They were aware that all church-state unions, beginning with the marriage of church and state in the early fourth century, continuing throughout the dark and middle ages, the reformation, and in the American colonies up until the time they lived resulted in horrible persecutions of those who would not bow down to the established beliefs.
Jefferson’s writings make clear his position on separation of church and state. For example, in 1779 he wrote the Virginia Act for Religious Liberty which was passed in 1786. The act included three factors: church, state, and the individual. It protected the individual from loss at the hands of state incursion into his church affiliation, and implicitly banned church establishment. Madison also fought for separation of church and state in Virginia. He wrote, in his famous “Memorial and Remonstrance:”
“… Because experience witnesses that ecclesiastical establishments, instead of maintaining the purity and efficacy of religion, have had a contrary operation. During almost fifteen centuries has the legal establishment of Christianity been on trial. What have been its fruits? More or less in all places, pride and indolence in the clergy; ignorance and servility in the laity; in both, superstition, bigotry, and persecution. Inquire of the teachers of Christianity for the ages in which it appeared in its greatest luster; those of every sect point to the ages prior to its incorporation with civil policy. Propose a restoration of this primitive state, in which its teachers depended on the voluntary rewards of their flocks, many of them predict its downfall….
“Because the establishment in question is not necessary for the support of civil government…. If religion be not within the cognizance of civil government, how can its legal establishment be said to be necessary for civil government? What influences, in fact, have ecclesiastical establishments had on civil society? In some instances, they have been seen to erect a spiritual tyranny on the ruins of the civil authority; in more instances, have they been seen upholding the thrones of political tyranny; in no instance have they been seen the guardians of the liberties of the people. Rulers who wished to subvert the publick liberty, may have found on established clergy convenient auxiliaries. A just government instituted to secure and perpetuate it needs them not. Such a government will be best supported by protecting every citizen in the enjoyment of his religion, with the same equal hand which protects his person and property; by neither invading the equal hand which protects his person and property; by neither invading the equal rights of any sect, nor suffering any sect to invade those of another….”
George Carlin is wiser concerning church/state separation than most Christians. Caveat: He knows nothing about true churches under Christ, since heretical, apostate, and unlearned churches and believers predominate the landscape.
Thus, when the First Amendment was introduced and promoted by James Madison, the only question was the exact wording of the Amendment. The representatives at the Constitutional Convention understood that the purpose of the religion clause was (1) to place a two way wall between church and state (This purpose is stated in the establishment clause: “Congress shall make no law respecting an establishment of religion.”) and (2) to provide for freedom of conscious, also known as free will or soul liberty (This purpose is stated in the free exercise clause: “or prohibiting the free exercise thereof.”). These two purposes go hand in hand. The historical established churches, beginning with the spiritual harlot called the Catholic “church” and then her offspring-Protestant “churches”- violently persecuted (hung, burnt at the stake, drowned, buried alive, imprisoned, tortured with unspeakable horror) those who exercised their God-given free will in contradiction to the doctrines of the church-state establishment and were labeled “heretics” by the established church.
At the seminar, I explained my position in more detail and showed that the same theology that justified union of church and state was initially developed and expanded upon from earlier sources by Augustine, practiced by the Catholic church, and later by Protestant churches (in modified form). Proponents of those same theologies remain at work to achieve the impossible goals of their adherents (peace and unity throughout the earth) in America today. In fact, many adherents of those theologies are very active in, and are leaders in, the contemporary American political warfare. Many believe that they will set up the kingdom of heaven on earth, the millennium, either through the efforts of the church or through a church-state combination and without the intervention our Lord Jesus Christ. Others believe that there is no millennium, and that a worldwide church-state combination will bring peace and unity to the earth. Others, such as myself, are totally convinced that the Bible teaches that Christ Himself will return at Armageddon and set up and reign over the earth for a thousand years by power. Along with the question of whether First Amendment separates church and state, another question that needs to be addressed is whether the Constitution or any other governing document requires the federal government to be guided by God and His principles? The Founding Fathers while implementing the biblical principle of separation of church and state in the First Amendment did not understand that a nation should, within her organic governing documents, recognize that the God of the Bible, the only God, that He should be honored and hailed as the ruler of nations, and that His principles should be recognized and applied within the laws of the nation and in the interpretation of those laws.
A nation can proceed under God without combining church and state. How? The constitution of such a nation will:
1) name the name of Jesus as the Supreme ruler;
2) make clear that the nation will look to the biblical doctrines of government, church, and separation of church and state in ordering and carrying out its responsibilities under God;
3) lay out its God-given jurisdiction as explained in the Bible;
The First Amendment to the U.S. Constitution
4) separate church and state. The First Amendment implements the biblical principle of separation of church and state.
5) provide for religious liberty (also called soul liberty or freedom of conscience). The First Amendment does this.
6) guarantee freedom of speech, press, assembly and the right to petition the government for a redress of grievances. The First Amendment does this.

The Constitution allows, but does not require, Americans to recognize the God of the Universe, the God of creation, almighty God, and to operate according to His principles and to pray in the name of Jesus even at government functions. This is obvious from a study of history including the multitude of statements made by Presidents, senators, representatives, government officials at all levels of government; and from a reading and study of state constitutions, laws, and federal and state legal cases.
History also shows that almost everyone in America at the time of the adoption of the Constitution reverenced the Bible and the God of the Bible and that prayers were made to Him at official government functions. Of course, the United States Supreme Court has removed the recognition of God (and especially the Lord Jesus Christ) from practically all civil government affairs. However, sad to say, neither the Constitution nor any other federal governing document names the name of Jesus and requires that the United States government be guided by God and His principles (being guided by God and His principles is something entirely different from establishing a church). If you disagree, show me one Constitutional provision or federal law which either requires recognition of God (and specifically the Lord Jesus Christ) and/or His principles as laid out in His Word. I submit that there is none.
Unlearned Christians (this author was once in their fold) argue that the implementation of certain biblical principles in the Constitution prove that the Constitution is a “Christian” document. However, they fail to point out the enlightenment principles which pollute the Constitution. I deal more in depth with these matters in God Betrayed.
Unstudied Christians argue, as this author once did, that the Declaration of Independence did recognize God and that Americans march behind the banner of the Declaration. However, the Declaration was written over a decade before the adoption of the Constitution and the First Amendment, and the Declaration is not law despite the rhetoric which says, “We proceed under the banner of the Declaration of Independence.” This author contends that even the Declaration is flawed when biblically analyzed. Even if the contention that it is not flawed were correct, the Declaration is not controlling law and an examination of the Declaration and the Constitution leaves open the obvious contention that Americans had changed between the time of the writing of the Declaration and the adoption of the Constitution.
The Bible teaches that a Gentile nation, as well as the nation Israel, that rejects the one true God, the God of the Bible, and His principles will become more and more morally bankrupt, will digress to political tyranny, and ultimately be judged by God. The United States is a moral cesspool and is well into the political tyranny stage. A thorough analysis is impossible in a short article such as this, but here are a few verses from the Old Testament which substantiate this conclusion:
“The LORD is high above all nations, and his glory above the heavens” Psm. 133:4.
“Let all the earth fear the LORD: let all the inhabitants of the world stand in awe of him…. “Blessed is the nation whose God is the LORD; and the people whom he hath chosen for his own inheritance…. There is no king saved by the multitude of an host: a mighty man is not delivered by much strength.” (Psm. 33.8, 12, 16; see the whole chapter of Psm. 33). [Bold emphasis mine]
“Why do the heathen rage, and the people imagine a vain thing? The kings of the earth set themselves, and the rulers take counsel together, against the LORD, and against his anointed, saying, Let us break their bands asunder and case their cords from us. He that sitteth in the heavens shall laugh: the LORD shall have them in derision. Then shall he speak unto them in his wrath, and vex them in his sore displeasure.…. Thou [Jesus] shalt break them with a rod of iron; thou shalt dash them in pieces like a potter’s vessel. Be wise now therefore, O ye kings: be instructed, ye judges of the earth. Serve the LORD with fear, and rejoice with trembling. Kiss the Son, lest he be angry, and ye perish from the way, when his wrath is kindled but a little. Blessed are all they that put their trust in him.” Psm. 2:1-5, 9-12 (The 2nd Psalm gives the order of the establishment of the kingdom.).
The Old Testament details God’s principles for nations, both Jew and Gentile, and lays out the complete history and fate of nations from beginning to end. God ordained civil government, and the fact that God desires nations to submit to Him and His principles is undeniable. That no nation ever has or ever will do so before He returns and establishes His Kingdom on earth is clear from a literal interpretation of scripture.
In spite of the flaws in the Constitution, America, to a great extent, originally honored God. Of course, the First Amendment was not a flaw; the religion clause was a statement of the biblical principle of separation of church and state. With the passing of time, the flaws in the document have made it easier for the natural progression of moral awfulness and political tyranny. This author, like most politically active “Christians” worked-not according to knowledge, understanding and wisdom-to “bring America back under God.” As a result of those efforts in the Republican Party (1982-beginning of the twenty-first century), I saw that America continued to grow worse in every way and at an accelerated pace in spite of our efforts. By 2002, I realized that America had become a grossly immoral nation. America is now a tyrannical and morally awful nation much worse than it was in 2002.
In 2005 God focused my efforts on His doctrine of the church, which is where they should have been in the first place. If Christians cannot get the doctrine of the church right in understanding and practice, how in the world do they think they can get civil government right? Even though many “believers” still seek to honor God in the political arena, they are not proceeding according to knowledge, wisdom, and understanding in either their government or their church efforts. God makes clear that when His people do not act according to knowledge (among other things), they will fall (See, e.g., 2 Pe. 1.2-10; Ho. 4).

En1. Jefferson wrote: “Is uniformity attainable? Millions of innocent men, women, and children, since the introduction of Christianity, have been burnt, tortured, fined, imprisoned; yet we have not advanced one inch towards uniformity. What has been the effect of coercion? To make one half the world fools, and the other half hypocrites. To support roguery and error all over the earth.” Jefferson understood that establishment of a church (a church working with, over, or under civil government) always brings the worst of persecution of those who do not bow down to the church-state or state-church union.”
Virginia Bill for Religious Liberty drafted by Thomas Jefferson in 1779 and enacted in 1786.
The Virginia Bill for Religious Liberty written by Jefferson and passed in 1786 stated:
“I. Well aware that Almighty God hath created the mind free; that all attempts to influence it by temporal punishments or burthens or by civil incapacitations, tend only to beget habits of hypocrisy and meanness, and are a departure from the Holy Author of our religion, who being Lord of both body and mind, yet chose not to propagate it by coercions on either, as was in his Almighty power to do;
that the impious presumption of legislators and rulers, civil as well as ecclesiastical, who, being themselves but fallible and uninspired men, have assumed dominion over the faith of others, setting up their own opinions and modes of thinking as the only true and infallible, and as such, endeavoring to impose them on others hath established and maintained false religions over the greatest part of the world and through all time;
that to compel a man to furnish contributions of money for the propagation of opinions which he disbelieves, is sinful and tyrannical; that even the forcing him to support this or that teacher of his own religious persuasion is depriving him of the comfortable liberty of giving his contributions to the particular pastor whose morals he would make his pattern, and whose powers he feels most persuasive to righteousness, … that our civil rights have no dependence on our religious opinions any more than [on] our opinions in physics or geometry;
that therefore the proscribing any citizen as unworthy the public confidence by laying upon him an incapacity of being called to offices of trust and emolument, unless he profess or renounce this or that religious opinion is depriving him injuriously of those privileges and advantages to which in common with his fellow citizens he has a natural right; …
that to suffer the civil magistrate to intrude his powers into the field of opinion and to restrain the profession or propagation of principles, on supposition of their ill tendency, is a dangerous fallacy, which at once destroys all religious liberty, because he being of course judge of that tendency, will make his opinions the rule of judgment, and approve or condemn the sentiments of others only as they shall square with, or differ from his own;
that it is time enough for the rightful purposes of civil government for its officers to interfere when principles break out into overt [open, or public] acts against peace and good order;
and, finally, that truth is great and will prevail if left to herself, that she is proper and sufficient antagonist to error and has nothing to fear from the conflict, unless by human interposition disarmed of her natural weapons, free argument and debate, errors [cease] to be dangerous when it is permitted freely to contradict them.
“II. Be it enacted by the General Assembly that no man shall be compelled to frequent or support any religious worship, place, or ministry whatsoever, nor shall be enforced, restrained, molested, or burdened in his body or goods, nor shall otherwise suffer on account of his religious opinions or belief; but that all men shall be free to profess, and by argument to maintain, their opinion in matters of religion, and that the same shall in no wise diminish, enlarge, or affect their civil capacities.
“III. And though we well know that this assembly, elected by the people for the ordinary purposes of legislation only, have no power to restrain the acts of succeeding assemblies, constituted with powers equal to her own, and that therefore to declare this act irrevocable would be of no effect in law, yet, as we are free to declare, and do declare, that the rights hereby asserted are of the natural right of mankind, and that if any act shall hereafter be passed to repeal the present or to narrow its operation, such act will be an infringement of natural rights.”
En2. The word millennium means “1000 years” and comes from Re. 20. 4-6 where it says that certain people “came to life, and reigned with Christ a thousand years. There are three major views on the time and nature of the millennium.
Amillennialism takes the position that this is a period during which Satan’s influence has been greatly reduced so that the gospel can be preached throughout the world. Christ does not bodily reign during this period, and there is no future millennium yet to come. Amillennialists believe that the term “thousand years” is a figure of speech for a long period of time in which God’s will will be accomplished. Christ will return at the end of this period, believers and unbelievers will be resurrected, unbelievers will be eternally condemned and believers reunited with their spirits, judged, and will enjoy heaven forever.
According to postmillennialism, Christ will return after the millennium. The church and state, operating during the period in which we now live, will establish peace and righteousness and a millennial age will occur when this occurs. At the end of that thousand years, Christ will return to earth, believers and unbelievers will be raised, the final judgment will occur, a new heaven and a new earth will be established, and we will enter into the eternal state.
Premillennialism teaches that Christ will return before the millennium, believers who have died will be raised from the dead, their bodies reunited with their spirits, will reign with Christ 1000 years. During this 1000 years, Satan will be bound. At the end of that period, he will be loosed and will lead the unbelievers of the millennium in rebellion against Christ. Satan and his followers will be defeated, Christ will raise the dead and they will be judged. Those whose names are not found written in the book of life will be cast, as was Satan, into the lake of fire. At the final judgment, believers will enter into the eternal state.
There are two main premillennial positions. Classic premillennialism says Christ will return after the great tribulation, rapture believers, and that believes will reign with Christ on earth for 1000 years. Pretribulational premillennialism teaches that Christ will return part way to earth before the tribulation, call believers to Himself, , and return to heaven with those believers. This will be followed by a seven year period of great tribulation. At the end of that time, Christ will return, crush all the Gentile armies which have come against Israel, and set up His millennial reign. The first government in history that was to have complete freedom of conscience and religious liberty also declared that the government was to be under the Lord Jesus Christ. Signed on March 7, 1638, the Portsmouth Compact read:

Three passages were marked in support of the compact: Exodus 24.3, 4; II Chronicles

In August of 1638, the people of Providence approved the first public document establishing government without interference in religious matters, the Providence Compact:

As James R. Beller proclaims, the document was “the first of a series of American political documents promulgating government by the consent of the governed and liberty of conscience” (James R. Beller, America in Crimson Red: The Baptist History of America (Arnold, Missouri: Prairie Fire Press, 2004), p. 13). Thus, liberty of conscience was the basis for legislation in Rhode Island, and its annals have remained to this day [when Underhill wrote this] unsullied by the blot of persecution. (Roger Williams and Edward Bean Underhill, The Bloudy Tenent of Persecution for Cause of Conscience Discussed and Mr. Cotton’s Letter Examined and Answered. (London: Printed for the Society, by J. Specifically, as to Gentile nations, many scriptures illustrate that God wants Gentile civil governments to recognize Him as who He is: for example, Exodus 7.5, 17; 14.4, 18 (Egypt); Ezekiel 25.11 (Ammonites); 25.14 (Edom); 25.17 (Philistia); 26.6, (Tyre); 28.22, 23, 24 (Zidon); 29.6, 9, 16, 21; 30.8, 19, 25; 32.16 (Egypt); 35.4 (Mt. Seir); 38.23 (the nations); 39.6, 7 (Magog & the heathen). Solomon, in his blessing after dedicating the temple said, “That all the people of the earth may know that the LORD is God, and that there isnone else” (1 K. 8.60). David, within his last words, said: “He that ruleth over men must be just, ruling in the fear of God. And he shallbe as the light of the morning, when the sun riseth, evena morning without clouds; asthe tender grass springing out of the earth by clear shining after rain” (2 S. 23.3-4). [To Nebuchadnezzar it was said] “they shall make thee to eat grass as oxen, and seven times shall pass over thee, until thou know that the most High ruleth in the kingdom of men, and giveth it to whomsoever he will” (Da. 4.32b). So it happened and so Nebuchadnezzar then, after being restored to his kingship, “[extolled and honoured] the King of heaven, all of whose works aretruth, and his ways judgment,” recognizing that “those that walk in pride [God] is able to abase” (Da. 4.37). So Nebuchadnezzar came to be called the “servant” of Jehovah (Je. 25.9; 27.6; 43.10). God judged King Belshazzar, Nebuchadnezzar’s son, because he did not humble his heart and “lifted up [himself] against the Lord of heaven” and had not glorified God “in whose hand [Belshazzar’s] breath [was]and whose [were]all his ways,” knowing what God had done to his father (See Da. 5.17-31). Darius, after seeing that God miraculously delivered Daniel when he was thrown into the den of lions, decreed: “That in every dominion of my kingdom men tremble and fear before the God of Daniel: for he isthe living God, and stedfast for ever, and his kingdom thatwhich shall not be destroyed, and his dominion shall be evenunto the end. He delivereth and rescueth, and he worketh signs and wonders in heaven and in earth, who hath delivered Daniel from the power of the lions” (Da. 6.26-27).
Cyrus chose to serve God: “That saith of Cyrus, He ismy shepherd, and shall perform all my pleasure: even saying to Jerusalem, Thou shalt be built; and to the temple, Thy foundation shall be laid. Thus saith the LORD to his anointed, to Cyrus, whose right hand I have holden, to subdue nations before him; and I will loose the loins of kings, to open before him the two leaved gates; and the gates shall not be shut” (Is. 44.28-45.1).
“Thus saith the LORD to his anointed, to Cyrus, whose right hand I have holden, to subdue nations before him; and I will loose the loins of kings, to open before him the two leaved gates; and the gates shall not be shut” (Is. 45.1). “This is the only instance where the word is applied to a Gentile. Nebuchadnezzar is called the ‘servant’ of Jehovah (Je. 25:9; 27:6; 43:10). This, with the designation ‘My shepherd’ (Is. 44:28) also a Messianic title, marks Cyrus as that startling exception, a Gentile type of Christ. The points are:(1) both are irresistible conquerors of Israel’s enemies. (Is. 45:1; Re. 19:19-21); (2) both are restorers of the holy city (Is. 44:28; Zec. 14:1-11); (3) through both is the name of the one true God glorified (Is. 45:6; 1 Co. 15:28).” (1917 Scofield Reference Edition, note 2 to Is. 45.1, page 753)
God sent Jonah to “cry against” the Gentile city of Nineveh “for their wickedness [had] come up before [Him] (Jona. 1.2).” After Jonah went through the city of Nineveh crying, “Yet forty days, and Nineveh shall be overthrown (Jona. 3.4),” “[t]he people of Nineveh believed God, and proclaimed a fast, and put on sackcloth, from the greatest of them even to the least of them” (Jona. 3.5). “And God saw their good works, that they turned from their evil way; and God repented of the evil, that he had said that he would do unto them; and he did it not” (Jona. 3.10). Unfortunately, more than a century later Nahum delivered an unrelieved warning of judgment because Nineveh had fallen back into moral awfulness (Na. 3.1-19). “[H]e will make an utter end: affliction shall not rise up the second time” (Na. 1.9). “According to Diodorus Siculus, the city was destroyed nearly a century later, precisely as [predicted by Nahum] (1917 Scofield Reference Edition, headnote to Na., p. 952).”
The nations which inhabited the land God promised to Abraham committed abominations, thereby defiling the land (Le. 18.6-27). God abhorred those nations because of those abominations (Le. 20.23). God did not drive them out from before Israel for the righteousness of Israel, for Israel was a stiffnecked people. Israel was to go possess the land because of the wickedness of the nations in the land and so that God “may perform the word which the LORD sward unto Israel’s fathers, Abraham, Isaac, and Jacob” (De. 9.4-6).
Thus God wishes each civil government to choose to rule for His glory under His precepts; that is, to establish free will for every individual while ruling under biblical principles, but not to enforce God’s rules concerning man’s relationship with God. Just as Belshazzar was without excuse in that he saw what God had done to his father, likewise rulers and civil governments today are without excuse in that the Word of God is available today for all to read and to know God’s principles and His ways.

In order to be qualified to comment upon the law, one must have an extensive legal education. He must understand how to do legal research and how to reach correct legal conclusions. Legal commentary by a pseudo lawyer can sound good to the untrained, while he may be correctly understood as frivolous and unlearned and probably heretical by the educated believer.
This is not to say that a non-lawyer cannot understand the legal and historical aspects of spiritual matters. In fact, the author knows some pastors and other believers who, having already correctly divided the Word of Truth and determined to seek to please God in all matters, have open minds and who have eagerly sought truth in the historical and legal church and state law arena. He is working with such a young pastor at this very moment. He is a brilliant young man who had mastered the Scriptures and Baptist history before the author met him. He excels the author in those matters, as do some other pastors and believers known by the author. Unlike most pastors, he does not have the disadvantages of having gone to either a secular or ecclesiastical (Baptist or otherwise) institution of higher learning. Secular colleges and universities usually corrupt even the most devout child of God; and religious colleges, institutions, and seminaries generally (with few exceptions, one of which the author has personal knowledge of)—by either mixing an ample dose of humanism with whatever biblically correct teaching they dose out; or by having totally having abandoned truth—likewise usually corrupt their students to one degree or another.
On the other hand, I am vexed by what I read in some books and websites concerning church and state law; particularly by some vicious, unfounded attacks upon the Biblical Law Center Declaration of Trust by unqualified, biased assailants who are attempting to mislead believers and churches through incorrect biblical and legal analyses and personal attacks upon and outright lies about those with whom they disagree in such matters.
Being a believer alone, even a pastor, does not by itself qualify one to teach on church and state law. The author has been a believer and faithful member of independent Baptist churches since his salvation. He was called by God to go to law school for His glory and to please Him. As a result of that calling, he obtained a Doctor of Jurisprudence degree from one of the best law schools in the country and has practiced law for seventeen years. He has no motive for dishonesty. By design, he has never made a dime above expenses in his work in the church and state law arena. In fact, he has spent tens of thousands of dollars with total income of at most three to four thousand dollars in all the years he has worked in this area of law. Because of this he is beholden to no one and nothing but the truth and his Lord and Savior. Since becoming a lawyer, he has devoted untold thousands of hours in biblical, historical, and legal study and analysis of church and state law.
As always, he declares that if anyone can show him where he is in error, he will recant. Honest, loving believers have taught him much and caused him to modify some of his positions. He has also, in his continued studies, modified some of his conclusions and positions. However, he maintains his primary positions because neither he, through his continued studies, or others have shown him to be wrong about his basic church and state law principles and conclusions.
The Bible, especially in the Old Testament, deals extensively with nations and shows that God ordained nations, that He is over every nation, but that He gives every nation a temporary choice of whether to submit itself to the sovereign God. The following verses, among many others, prove that God is over all nations and wishes each nation to choose to glorify Him:
“When the Most High divided to the nations their inheritance, when he separated the sons of Adam, he set the bounds of the people according to the number of the children of Israel” (De. 32.8).
“Be wise now therefore, O ye kings: be instructed, ye judges of the earth. Serve the LORD with fear, and rejoice with trembling. Kiss the Son, lest he be angry, and ye perish from the way, when his wrath is kindled but a little. Blessed are they which put their trust in him” (Ps. 2.10-12. See Ps. 2 in its entirety).
“The wicked shall be turned into hell and all nations that forget God” (Ps. 9.17).
“If the foundations be destroyed, what can the righteous do” (Ps. 11.3)?
“Make a joyful noise unto the LORD, all ye lands. Serve the LORD with gladness: come before his presence with singing. Know ye that the LORD he is God: it is he that hath made us, and not we ourselves; we are his people, and the sheep of his pasture” (Ps. 100.1-3).
“The LORD is high above all nations, and his glory above the heavens” (Ps. 113.4).
“Righteousness exalteth a nation, but sin is a reproach to any people” (Pr. 14.34).
“A wise king scattereth the wicked, and bringeth the wheel over them” (Pr. 20.26).
“Mercy and truth preserve the king: and his throne is upholden by mercy” (Pr. 20.28).
“Take away the wicked from before the king, and his throne shall be established in righteousness” (Pr. 25.5).
“When the righteous are in authority, the people rejoice: but when the wicked beareth rule, the people mourn” (Pr. 29.2).
“Behold, the nations are as a drop of a bucket, and art counted as the small dust of the balance: behold, he taketh up the isles as a very little thing…. All nations before him are as nothing; and they are counted to him less than nothing, and vanity…. It is he that sitteth upon the circle of the earth, and the inhabitants thereof are as grasshoppers; that stretcheth out the heavens as a curtain, and spreadeth them out as a tent to dwell in: That bringeth the princes to nothing; he maketh the judges of the earth as vanity. Yea, they shall not be planted; yea, they shall not be sown: yea, their stock shall not take root in the earth: and he shall also blow upon them, and they shall wither, and the whirlwind shall take them away as stubble. “But thou [Jeremiah] shalt say unto them, This is a nation that obeyeth not the voice of the LORD their God, nor receiveth correction: truth is perished, and is cut off from their mouth” (Je. 7.28. See the entirety of Je. 7).
“At what instant I shall speak concerning a nation, and concerning a kingdom, to pluck up, and to pull down, and to destroy it; If that nation, against whom I have pronounced, turn from their evil, I will repent of the evil that I thought to do unto them. And at what instant I shall speak concerning a nation, and concerning a kingdom, to build and to plant it; If it do evil in my sight, that it obey not my voice, then I will repent of the good, wherewith I said I would benefit them” (Je. 18.7-10).
Paul speaking to those at Lystra who would have worshiped Paul and Barnabas because Paul healed the impotent man on his 1st missionary journey said: “And saying, Sirs, why do ye these things? We also are men of like passions with you, and preach unto you that ye should turn from these vanities unto the living God, which made heaven, and earth, and the sea, and all things that are therein: Who in times past suffered all nations to walk in their own ways. Nevertheless he left not himself without witness, in that he did good, and gave us rain from heaven, and fruitful seasons, filling our hearts with food and gladness” (Ac. 14.15-17).
Paul said in his sermon on Mars’ hill: “God that made the world and all things therein, seeing that he is Lord of heaven and earth, dwelleth not in temples made with hands; … And hath made of one blood all nations of men for to dwell on the face of the earth, and hath determined the times before appointed, and the bounds of their habitation; That they should seek the Lord, if haply they might feel after him, and find him, though he be not far from every one of us: For in him we live, and move, and have our being; as certain also of your own poets have said, For we are also his offspring” (Ac. 17.24, 26-31).
“Which in his times he shall shew, who is the blessed and only Potentate, the King of kings, and Lord of lords” (1 Ti. 6.15).
When one studies the relevant principles of God and history recorded throughout the entire Old Testament, he discovers that God ordained the nations and civil government, laid out the jurisdiction of civil government, holds every nation to account in accordance with the nation’s recognition of Him as the one and only God (as opposed to the one and only god, Satan) and according to the nations application of His principles, and makes plain the consequences of obedience and the consequences of disobedience by a nation. He tells the story of the nations from the beginning until the end. One can look at Israel to see where humanity is on God’s time line as revealed in the Word of God.
Obviously, civil governments still exist and still have responsibility under God to rule for Him, but He still gives every civil government a choice of whether to go by His or Satan’s principles. “[The civil magistrate] ought to cherish, as a foster-father, the Lord Jesus, in his truth, in his saints, to cleave unto them himself, and to countenance them even to the death, yea, also, to break the teeth of the lions, who offer civil violence and injury unto them” (Roger Williams and Underhill, The Bloudy Tenent of Persecution for Cause of Conscience Discussed and Mr. Cotton’s Letter Examined and Answered (London: Printed for the Society, by J. Sadly, civil governments do not choose, at least for any significant period of time, to be “under God,” to guide their actions by His principles. Patrick Henry [who led the fight in Virginia against ratifying the Constitution, and was a great defender of the Baptists who were persecuted in Virginia even though he was in favor of a state-church] understood this:
“Where are your checks in this government. Your strongholds will be in the hands of your enemies. It is on the supposition that your American governors shall be honest, that all the good qualities of this government are founded; but its defective and imperfect construction puts it in their power to perpetrate the worst of mischiefs, should they be bad men. And sir, would not all the world, from the eastern to the western hemispheres, blame our distracted folly in resting our rights upon the contingency of our rulers being good or bad? Show me that age and country where the rights and liberties of the people were placed on the sole chance of their rulers being good men, without a consequent loss of liberty.” (John Eidsmoe, Christianity and the Constitution: The Faith of Our Founding Fathers (Grand Rapids, Michigan: Baker Book House, 1987), p. 309, quoting Patrick Henry, Virginia Ratifying Debates; quoted by Tyler, Patrick Henry, p. 328.).

Let me preface this article by saying that I believe God desires America and every Gentile nation to operate under Him and His principles (I explain this fully in the book mentioned below). In order for a nation to so operate, she must be led by knowledgeable, active Christians who walk in the Spirit according to wisdom, knowledge, and understanding. Most Christians in America have not so walked. As a result, our individuals, families, and then churches fell, followed by our nation.
The steps in the downfall of any nation are religious apostasy, moral awfulness, and political anarchy. America is well into the third stage. The blame belongs to pastors, Christians, and churches, not to the lost. The lost cannot get things right. Likewise, carnal, baby, or misled Christians cannot get things right.
As many of you know, I have many times forwarded the Wake-Up Herald because of the tremendous insights or information imparted therein. However, I take strong issue with much of what is in this issue of the Wake-Up Herald (see below). Men like R. J. Rushdooney, Gary Demar, Gary North and other “dominion theologists” have led American Christians down the wrong path for many years.
Since American Christians have followed and promoted lies for many years, America has gone downhill. However, and more importantly, American churches have sunk deeper into heresy, many into apostasy, with each passing year. An army of Christians, following incorrect biblical teachings such as those of Rushdooney, have led the way. They have fought to bring America back to God, but they have fought without true knowledge, understanding, and wisdom. I believe that Satan is very pleased with the efforts of the vast majority of Christians in America.
The leaders of the movement – as well as many of the followers – for the most part, have been following the lie that the church and state working together will bring peace and unity to America and to the earth and thereby will usher in the kingdom of heaven to the earth. Of course, most of those Christians who have been working for this goal have no idea of what they are doing – they are just doing because they truly want to serve God. Sadly, they have not put on the whole armor of God and they are working in the flesh rather than in the Spirit with knowledge, wisdom, and understanding.
R.J. Rushdooney as with all dominion theologists, has incorrectly divided Scripture concerning the issues of church and state or civil government. I have covered the biblical teachings on government, church, and separation of church and state as well as the American application thereof, in God Betrayed/Separation of Church and State: The Biblical Principles and the American Application. Despite Jesus’ urging, the Pharisees and Sadducees refused to look at the evidence – including the historical evidence, facts, and history – in the Scriptures that would have proven to them that Jesus was the Messiah. Most modern day “Bible believing Christians” likewise have their eyes closed to true biblical teaching (concerning history, law, and theology), as well as the application of those and also history, law, and the application of Bible teaching in America.
Before we can get America straightened out, Christians must get their churches straightened out in every way. In order to straighten our churches out, individual Christians, families, and churches themselves must begin to walk in the Spirit according to knowledge, wisdom, and understanding in all the principles in the Word of God. One cannot hope to get America straightened out without first getting themselves, their families, and their churches in line with the Word of God.
God has called me to the ministry of helping churches who love the Lord and want to to please Him by operating according to New Testament principles instead of according to the principles for the Jewish religion laid out in the Old Testament. Most American churches have chosen to dishonor God by becoming state religious organizations through incorporation, corporation sole, unincorporated association, 501c3, etc. Many of those who have tried to honor God in this area are dishonoring Him in other ways. Ignorance (many times wilful), fear, pride, and greed dominate most of our Bible-believing churches.
I am involved with this issue because God called me into this ministry. I could be living a much quieter and materially richer life if I discarded the knowledge, understanding, and wisdom God has revealed to me through intense study over the last few years. However, such a life would not be peaceful since I would be refusing to serve my Savior according to His leading.
If those of you who have been following the same lies I followed for many years choose to continue in your futile efforts to return to the status of a nation under God, keep working. Churches, as they continue to operate in a manner displeasing to our Lord, will continue to sink deeper into heresy and apostasy, the number of people saved as a percentage will continue to decrease, churches will continue to become more dead spiritually, and America will continue to decline as it has for many years in spite of all the efforts of well-meaning “Christians.”
The following verse, although directly addressing the Jews, applies (although not perhaps to their salvation): “For I bear them record that they have a zeal of God, but not according to knowledge” Romans 10:2.
After we as Christians get ourselves and our churches straightened out, then maybe we can make a difference in America; that is, if it is not too late for America.

Funny, isn’t it? If Christians talk about reconstructing America , putting all things under Christ, or exercising dominion, the media pundits panic and you hear all sorts of hysteria about “theocracy” and “Christian Taliban.” But when God-rejecting leftists talk about “remaking America,” and actually set about doing it—well, then it’s only “hope and change.”
The totalitarian reconstruction of America proceeds at a dizzying pace. It is, in Robert Knight’s words, “the rapid, brick-by-brick installation of a radical government-directed social order that will have dangerous implications now and for generations to come”. And, “Before our very eyes we are seeing government become Provider, Judge, and Possessor of All Authority. In short, government is becoming a secular god to which all will be called to kneel—or face sanctions”.

The Basic Problem
“What then is the basic problem? Not only is every Church a religious institution, but every state or social order is a religious establishment. Every state is a law order, and every law order represents an enacted morality, with procedures for the enforcement of that morality. Every morality represents a form of theological order, i.e., is an aspect and expression of religion. The church thus is not the only religious institution; the state is also a religious institution….The real issue is not between church and state, but is simply this; the state as a religious establishment has progressively disestablished Christianity as its law foundation, and, while professing neutrality, has in fact established humanism as the religion of the state.
When the religion of a people changes, its laws inevitably reflect that change and conform themselves to the new faith and the new morality. There has been deception on the part of the courts, by their profession of religious neutrality, as they have substituted one religion for another, humanism for Christianity. The basic reason, however, has been the theological collapse of the churches, and this has been true of all of them….This theological collapse led to the untenable belief in religious neutralism and to the surrender of Christian schools for statist education.
As a result humanism became the established religion of state and school, and, by infiltration, of the churches as well….Christianity is quite logically progressively excluded from state, school, and church and has a weak and scarcely tenable position in modern life. It (Christianity) probably lacks extensive and organized persecution in most countries because orthodox Christianity has become progressively weaker and less and less relevant.”

Anti-Christian Worldview
It is a worldview that is anti-Christian to the core. “When man, instead of God, becomes the measure of all things,” Knight says, “man will be worshipped at the same time as human life is cheapened … other human beings, such as unborn babies, can be seen as impediments to personal happiness.”
If there is no God, no judgment, no life after death, there remains only the here and now, with each one of us in existential isolation; and whatever you’re going to get, you’d better get it now. But ultimately the only ones who profit are the rulers of the state.
“The reason government wants to control health care,” Knight explains, “is that the government would assume literally the power of life and death over American families. Just the threat of withholding medical care is enough for many people to surrender other freedoms to the government. Such a system also reinforces the idea that government is God.”
Irrelevant Churches
America’s Christian heritage is both rich and deep. What most historians and educators refuse to acknowledge, our forebears understood clearly: it was mostly Christians and churches that formed and shaped the new land that became known as the United States of America .
For example, when discussing the brave exploits of the passengers on board the Mayflower, people seem to have forgotten that the voyage was mostly the endeavor of a single church congregation. And don’t forget that it was Pastor Jonas Clark’s male congregants who withstood British troops at Lexington and fired the very first of the shots heard ’round the world. The famous French historian, Alexis De Tocqueville, credited the pulpits and churches of Colonial America with inspiring America ‘s successful War for Independence and subsequent prosperity much more than its institutions of learning, halls of Congress, or industries of invention. From the very beginning, America ‘s Christians and pastors were intricately involved in the establishment and building of this republic.
It is no hyperbole to say that without the influence, sacrifice, dedication, blood, sweat, and tears of America ‘s early Christians, this country would not exist.
But what do we see today? We see pastors and church congregations who are, for the most part, totally ignorant of their own heritage and history. They have little or no understanding of the principles of Natural Law–something America ‘s founders knew almost by second nature (no pun intended). They seem to know next to nothing of the Biblical principles of liberty and government. All they seem to be able to do is regurgitate some mindless interpretation of Romans 13–an interpretation that could have been written by King George III or even Adolf Hitler.
Ignoring the great examples and exhortations of both Testaments, today’s Christians seem to have lazily latched onto a modern-day “divine right of kings” philosophy, through which they have become the pathetic slaves of arrogant and pompous political wolves dressed (barely) in the sheepskins of legitimacy.
Where are America ‘s watchmen on the wall? Where are the great stories of courage and commitment demonstrated by America ‘s founders that once emanated from church pulpits? How is it that today’s Christians know more about sports celebrities than they do America ‘s heroes? How is it that these lying, conniving, con artists called politicians can sucker church members as easily as they do the un-churched? How is it that Christians do not seem to recognize the devilish doctrines of socialism, fascism, elitism, or globalism for what they are? How can they be so easily manipulated? How is it that these corrupt politicians–who vote to kill unborn babies, merge America into internationalist and global entities, strip Americans of their God-given natural right of self defense, promote homosexual marriage, or allow America to lose its identity, culture, and heritage through unbridled illegal immigration–remain in “good standing” with any number of supposed “Christian” churches?
Even though there are more churches in America than anywhere else in the world, the pastors and Christians of this country have, for the most part, become completely irrelevant to preserving “the blessings of liberty”–or even fundamental Biblical principles, for that matter.
Churches used to be respected as lighthouses in communities: places free from the jaundiced juxtaposition of political correctness and avarice. Today’s churches are filled with both. Where once churches stood as guardians of truth, they have now become progenitors of error. Where once preachers stood in the similitude of Elijah and John the Baptist, they now grovel in the image of Joel Osteen and Rick Warren. Sunday Schools were once bastions of Bible teaching; today they are glorified coffee shops and playgrounds. The modern Christian home cannot even disciple its own children: how can it then be expected to “make disciples of all nations”?
I repeat, the modern American church has, for the most part, become irrelevant.
It is little wonder that more and more people are losing interest in the organized church. Instead of finding Christian love and kindness, they find the same kind of gossip, slander, petty bickering, favoritism, and selfishness that they might find at any office water cooler. Instead of hearing a prophet of God declare the Word of God, they hear a milquetoast minister meekly musing the latest self-help book.
The complete irrelevance of today’s organized church in America to the preservation of Christian liberty and constitutional government is especially disconcerting to those of us who still have freedom’s fire burning in our souls. Where do we go for respite and instruction?
I tell you the truth: there are hundreds of thousands of patriotic, freedom-minded Christians all over America who have had it “up to here” with these spineless social clubs called churches! They are tired of petrified pastors groveling before corrupt politicians and businessmen. They hunger for truth, and they are not finding it in most organized churches.
These people are not looking to be entertained or pampered. They do not care about social standing or making “business contacts.” They don’t care which church has the “most exciting” youth program, or how many softball teams it has. They want a church where the pastor isn’t afraid to speak truth to power and take a stand for liberty. And, unfortunately, such churches are getting harder and harder to find.
In fact, I submit that the true church is not “emerging”; it is “submerging.” As in totalitarian regimes all over the world, where there are basically two types of churches: the organized State-approved church, where people who worship the State go to put on a religious show; and the underground church, where real Christians go to worship God with honest, like minded believers.
The “underground” church in America is not totally underground–yet. But the schism is taking place rapidly.
